• Fitness for a particular purpose

• Accuracy or reliability of data erasure

• Non-infringement

We do not guarantee that:

• Software will meet all your business or legal requirements

• Erasure will be accepted by every regulatory body (unless certified by a relevant body such as ADISA)

• Services will be error-free or uninterrupted at all times

5. Limitation of Liability

To the maximum extent permitted by law, MidBird Technologies and its affiliates, employees, directors, or agents shall not be liable for:

• Indirect, incidental, or consequential damages

• Loss of data, profits, revenue, or business opportunities

• Damages resulting from unauthorized access, use, or alteration of your transmissions or data

• Issues arising from third-party software or integration partners

Our total liability under any circumstance shall not exceed the total amount paid by you to MidBird for the service or software in the past 12 months.

• Upload viruses or malicious code

7. Compliance and Regulatory Responsibilities

It is your responsibility to ensure that your use of MidBird’s products and services complies with all applicable laws and regulations, including but not limited to:

• GDPR (General Data Protection Regulation – EU)

• CPRA/CCPA (California Privacy Rights Act)

• HIPAA (Health Insurance Portability and Accountability Act – US)

• SOX, GLBA, NIST 800-88, NIST 800-53, and ISO 27001

• Indian IT Act 2000 (as amended)

We provide tools and certificates to support your compliance but do not act as legal advisors. You must conduct your own audits and legal checks.

8. Confidentiality

All information exchanged between you and MidBird Technologies marked as “confidential,” or that should reasonably be understood to be confidential, must be kept confidential and not disclosed to third parties, unless:

9. Termination and Suspension
